Please review these policies carefully as the following Terms & Conditions of entry to the studio and enrolment govern your payment, enrolment and use of the studio at Pole Fitness Australia, Everton Park.

Release and Waiver of Liability: All clients agree to the following:

I understand, acknowledge and agree that the activities of pole dancing are dangerous and as such, have inherent dangers and risks, including risk of injury or death. I acknowledge that the activities I undertake are at my own risk and therefore it would be unreasonable for Pole Fitness Australia to be responsible in any way for any injury or any kind of death. I hereby waive all legal rights of action against and fully release Pole Fitness Australia, it’s directors, instructors, employees, landlords and leases for the loss, damages or injuries arising out of or in relation to the participation by myself in the activities conducted or organised by Pole Fitness Australia. Including, without limitation, liability of any negligent or tortous act or omission, breach of duty, breach of contract or breach of statutory duty on the part of Pole Fitness Australia or related parties. I confirm that I assume the risk of, and the responsibility for any injury resulting from my participation in my activities. I participate in activities at my sole risk and responsibility and release, indemnify and hold harmless Pole Fitness Australia.

Pregnancy

Pole Fitness Australia do not recommend that you participate in pole dancing whilst pregnant. In the event of an unexpected pregnancy prior to the course starting we will not refund any deposit paid unless we have 14 days notice prior to the commencement of the course. If the course has been paid in full and is less than 14 days notice before the commencement of the course, we may transfer the payment to another course within the 12 month period. This is at the discretion of Pole Fitness Australia Management. If we receive notice of 14 days prior to the course commencing then we will refund the full amount of fees paid.

Alcohol and drug consumption

Strictly no alcohol is to be consumed on the premises of Pole Fitness Australia. I understand and acknowledge the dangers associated with the consumption of alcohol or any mind altering drugs before and during the activity and take full responsibility for any injury, loss or damage associated with their consumption. I agree to not drink alcohol or take drugs prohibited by law before or during any activities conducted or organised by Pole Fitness Australia. I also agree that if I am taking pain killers for physical injuries then I should not participate in pole dancing until the pain is resolved. In the event of a Hens/Girls/Birthday party or any other booked event, instructional class or course with Pole Fitness Australia there will be NO alcohol served or consumed by any student/participant or non-participant prior to or during the event. Pole Fitness Australia will not be held responsible for any injury or death as a result of participant/non-participant being intoxicated prior to entry or during an event. One glass of non-alcoholic champagne will be served at parties only.

Conduct

I agree to the follow the directions of the instructor and that any misconduct or refusal by me to follow any direction of the instructor or rules of the studio can result in the cancellation of my lesson and my immediate removal from the class. I understand that such non-compliance may result in injury of any kind whatsoever as a result of my failure to comply. Rules of the studio are clearly displayed in both reception and the dance areas.

Health

I acknowledge I have been advised to consult with my physician with respect to any past or present injury, illness, pregnancy or any other health related condition or any kind whatsoever that may affect my participation and ability to participate in the program. I acknowledge that I have discussed the appropriateness of the pole dancing program in connection with any illness or condition that I have or have had with my physician, and that I knowingly execute this release from liability and negligence. I acknowledge that Pole Fitness Australia DOES NOT recommend that pregnant women participate in pole dancing.

Payments & Refund Policy

Refunds or the transfers of fees to another term will not be granted under any circumstances except for:

1) Courses cancelled due to student’s ill health are credited for the remainder value to be used within 12 months. In order to receive this credit you must give written notice and a medical certificate that confirms that sickness or incapacity. This will still remain at the discretion of Pole Fitness Australia Management.

Cancellations at the discretion of Pole Fitness Australia

Pole Fitness Australia reserves the right to change or cancel a class up to and including the date of the course if sufficient bookings have not been received. In the event of a class or course being cancelled, every effort will be made to avoid inconvenience by offering alternative dates and times. If we are not able to offer a suitable alternative class, a refund will only be granted at the discretion of Pole Fitness Australia Management.

Catch up classes

Pole Fitness Australia strongly recommends that you attend all of your booked classes, however, in the event that you are unable to attend the class that you enroll in, a catch up class may be offered (if available and will not be specifically scheduled catch up class for you) as an alternative class of equivalent value. All catch up classes must be taken in the same term and cannot be transferred / rolled over to another term. We are unable to schedule catch up classes.

Deposits

A $30 deposit fee is required to book a place on a course at the time of booking to reserve your space with the balance payable on or before the first day of your course. Deposits paid prior to the commencement of the course are transferable but not refundable.

Intellectual Property

Pole Fitness Australia reserves the rights in all intellectual property, including but not limited to any moves, tricks, routines, course style and structure taught in any activities conducted or organised by Pole Fitness Australia. I understand and agree that I must not use or exploit any intellectual property owned by Pole Fitness Australia or personal financial gain in any manner, including but not limited to instructing or teaching pole dancing, without first obtaining the written permission of Pole Fitness Australia’s proprietors. I agree that I will not video or record any routines unless I am authorised to do so by Pole Fitness Australia proprietors and will under no circumstances post videos of Pole Fitness Australia’s choreographed routines on the internet or to the general public.

Feedback & Suggestions

If a student feels dissatisfied with some aspect of Pole Fitness Australia service, you are encouraged to first speak to the person responsible, for example the teacher if it is a class issue or the receptionist if it is an administration issue. If the student has attempted to resolve the matter informally, but is not satisfied with the outcome then you may choose to discuss it with the Studio Manager and you may be accompanied or assisted by a support person during that time. Students can be confident that there will be no negative consequences from doing so. The Manager will consider the problem and reply with an outcome within 5 working days. We are very happy to hear all feedback as this helps to continually improve our service. Anonymous feedback forms are available at reception should you wish to comment.
